Drug Crimes

Rockland County Drug Crime Defense Attorney

Legal Defense Against Drug Charges in NY

The federal government and the state of New York have stringent regulations regarding the use, manufacturing, possession, and distribution of drugs. The Controlled Substances Act divides drugs into five schedules, numbered I through IV based on their potential for abuse, medical use and potential for psychological or physical dependence.

Drug crimes vary in severity and are punished according to the schedule and amount of the drug as well as the type of crime, but all carry harsh penalties, which is why it is imperative to retain the representation of an experienced Rockland County criminal defense lawyer.

Understanding Drug Crime Charges

There are many different types of drug crimes because every state as well as the federal government prohibits the possession, manufacture and sale of certain controlled substances.

  • Drug crimes include the following:
  • Possession
  • Marijuana possession
  • Sales
  • Distribution
  • Manufacturing
  • Trafficking
  • Smuggling
  • Prescription fraud

What are the Penalties For Drug Charges in New York?

Penalties for drug crimes can include long prison sentences and expensive fees. Selling a controlled substance, for example, is a felony in the state of New York. Penalties for selling drugs range from one year in prison or $5,000 in fines for first-time offenders convicted of fifth-degree offenses to life imprisonment or $100,000 in fines for major drug traffickers. Possession, the least serious of drug crimes in New York, can still lead to 20 years imprisonment or a fine of $100,000.

New York's Stance on Recreational Marijuana Use

New York Gov. Andrew Cuomo legalized recreational cannabis use, possession, sale, and cultivation on March 31, 2021. Adults who are at least 21 years old may possess up to three (3) ounces of marijuana or up to 24 grams of concentrated cannabis for personal use.

In addition, residents may grow up to six (6) plants per person or 12 plants per household. Lastly, it is legal to smoke marijuana in places where smoking tobacco is legal, unless specifically restricted by specific municipalities.

Possession of more than the legal amount or sale of cannabis without a license can be charged as either a misdemeanor or a felony.
