Penalties for Marijuana Possession in New York

Adults who are 21 years of age or older can carry up to three (3) ounces (oz.) of marijuana or up to 24 grams of concentrated cannabis for personal use. However, possession of more than three (3) ounces of pot can result in criminal charges.

Marijuana possession penalties in New York can include:

  • More than three (3) to eight (8) oz. – A misdemeanor punishable by up to one (1) year in jail and/or a maximum fine of $1,000.
  • More than eight (8) oz. to one (1) lb. – A felony punishable by imprisonment for up to four (4) years and/or a maximum fine of $5,000.
  • More than one (1) lb. to ten (10) lbs. – A felony punishable by imprisonment for up to seven (7) years and/or a maximum fine of $5,000.
  • More than 10 lbs. – A felony punishable by imprisonment for up to 15 years and a maximum fine of $15,000.
