Since the passing of "Leandra's Law" in 2009, every New York driver convicted of a misdemeanor or felony DWI since August 15, 2010, has had to deal with ignition interlock devices as part of their penalties (this also applies to out-of-state drivers convicted of DWI in the State of New York). These devices must be installed for the duration of the offender's probation or conditional discharge, which, depending on the offense and the driver's history, can be anywhere from one to five years. How Ignition Interlock Devices Work

Ignition interlock devices (IIDs) are basically breathalyzer devices that are installed in your car. Drivers must blow into the device and register a blood alcohol content level of 0.024 or lower. If they do not, their car will not start and they will be prevented from driving.

  • Some key points to know about ignition interlock devices:
  • On longer drives, the IID may prompt mid-trip tests.
  • A reading of 0.025 or higher reading will trigger a second test.
  • If the second test is missed/failed, you have five calendar days to have your car serviced or it will become inoperable.
  • If a convicted driver is found driving without an IID, they can be penalized with up to one year in jail.
  • Many IIDs are equipped with cameras to prevent others from taking the breath test on behalf of the convicted driver.
  • Anyone found assisting a driver by taking an IID breath test is also subject to a penalty of up to one year in jail.
